Terms of service
These Terms of Service (hereinafter referred to as “the Terms”) set forth the conditions for use of the online shop (hereinafter referred to as “the Service”) provided by Contrail Camera.
All registered users (hereinafter referred to as “the Users”) agree to use the Service in accordance with the Terms below.
Article 1 – Application
These Terms shall apply to all relationships between the Users and the Company regarding the use of the Service.
In addition to these Terms, the Company may establish individual rules and guidelines (hereinafter referred to as “Individual Regulations”).
If any provision of these Terms conflicts with an Individual Regulation, the Individual Regulation shall prevail, unless otherwise specified.
Article 2 – Sales Agreement
A sales agreement between the User and the Company shall be concluded when the User submits a purchase order through the Service and the Company sends a notice of acceptance.
Ownership of the product transfers to the User at the time the Company hands over the product to the delivery carrier.
The Company may cancel the sales agreement without prior notice if:
1. The User violates these Terms.
2. Delivery cannot be completed due to an unknown address or prolonged absence.
3. The Company deems that the relationship of trust with the User has been damaged.
Payment methods, shipping methods, order cancellations, and return procedures shall be governed by methods separately prescribed by the Company.
Article 3 – Intellectual Property Rights
All copyrights and other intellectual property rights in product images and other content provided through the Service (hereinafter “Content”) belong to the Company or legitimate right holders.
Users may not reproduce, transmit, modify, or otherwise use any Content without permission.
Article 4 – Prohibited Acts
Users shall not engage in any of the following acts while using the Service:
1. Acts that violate laws or public order and morals
2. Acts related to criminal behavior
3. Infringement of copyrights, trademarks, or other intellectual property rights
4. Disruption or interference with the Company’s servers or networks
5. Commercial use of information obtained through the Service
6. Acts that may interfere with the operation of the Service
7. Unauthorized access or attempts thereof
8. Collecting or storing personal information of other Users
9. Impersonating other Users
10. Providing benefits, directly or indirectly, to antisocial forces in connection with the Service
11. Any other act deemed inappropriate by the Company
Article 5 – Suspension of the Service
The Company may suspend or interrupt all or part of the Service without prior notice to Users if any of the following applies:
1. Maintenance or updates to the system are required
2. Provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
3. The computer or communication lines are stopped due to accidents
4. Other cases where the Company deems it difficult to provide the Service
The Company shall not be liable for any damages or losses incurred by Users or third parties as a result of such suspension or interruption.
Article 6 – Restriction of Use and Deregistration
The Company may restrict a User’s access or cancel registration without prior notice if:
1. The User violates any provision of these Terms
2. False information is found in the registration details
3. The credit card provided is suspended
4. The User fails to fulfill payment obligations
5. The User does not respond to Company communications for a certain period
6. The Service is unused for a long period
7. The Company otherwise deems the User inappropriate for continued use
The Company shall not be liable for any damages arising from such actions.
Article 7 – Disclaimer
The Company makes no warranty, express or implied, that the Service is free of defects, errors, bugs, security vulnerabilities, or infringements.
The Company shall not be liable for any damages incurred by Users arising from use of the Service.
However, if the agreement between the Company and a User constitutes a consumer contract under Japanese law, this disclaimer does not apply to the extent prohibited by law.
Even in such cases, the Company shall not be liable for any indirect, special, or consequential damages arising from negligence (except gross negligence).
The Company assumes no responsibility for transactions, communications, or disputes between Users or between Users and third parties arising from or related to the Service.
Article 8 – Changes to the Service
The Company may change or discontinue the content of the Service without prior notice.
The Company shall not be liable for any damages resulting from such changes or discontinuation.
Article 9 – Revisions to the Terms
The Company may revise these Terms at any time without prior notice if deemed necessary.
By continuing to use the Service after such changes, the User shall be deemed to have agreed to the revised Terms.
Article 10 – Handling of Personal Information
Personal information obtained through the Service shall be handled appropriately in accordance with the Company’s Privacy Policy.
Article 11 – Notifications and Communication
All notifications and communications between Users and the Company shall be conducted in accordance with the Company’s designated methods.
Unless the User notifies a change in contact details, the Company shall deem the registered contact information valid and that any communications sent to it are received at the time of transmission.
Article 12 – Prohibition of Assignment of Rights
Users may not transfer or pledge their contractual position or any rights or obligations under these Terms to any third party without prior written consent from the Company.
Article 13 – Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan.
The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company’s head office.
